PURCHASE CONDITIONS
The following is the contractual document that shall govern the contracting of products and services through the website www.carrascoibericos.com, owned by SANTOS CARRASCO MANZANO S.A. (hereinafter CARRASCO IBÉRICOS). The acceptance of this document implies that the USER:
- Has read, understood and comprehended the information thereof.
- That the user has sufficient capacity to enter into a contract.
- That the user undertakes all obligations set forth herein.
These conditions shall be valid for an indefinite period of time and shall be applicable to all products and services contracted through the CARRASCO IBÉRICOS website www.carrascoibericos.com. CARRASCO IBÉRICOS reserves the right to unilaterally modify these Terms and Conditions, without affecting the goods or promotions that were acquired prior to the modification.
IDENTITY OF THE PARTIES
On the one hand,
The supplier of the goods or services contracted by the USER is SANTOS CARRASCO MANZANO S.A., with offices at C/PRÍNCIPE FELIPE, 25 37770 GUIJUELO, SALAMANCA, tax ID (CIF) A37051646, registered in the Mercantile Registry of Salamanca, Volume 115 General, Book 61 of the 3rd Section of Companies, Page Nº1126, 1st Inscription, and with customer care telephone number 923580420,
On the other part;
The USER, either by registering on the website by means of a USER name and password (for which the user has full responsibility regarding use and custody), or by accessing the services provided on the website as a guest and, in any case, being responsible for the accuracy of personal data provided to CARRASCO IBÉRICOS.
PURPOSE OF THE AGREEMENT
The purpose of this agreement is to regulate the contractual relationship between CARRASCO IBÉRICOS and the USER when the USER accepts the corresponding box during the online contracting process.
Contractual sales relationship involves product delivery in exchange for a certain price that is publicly displayed through the website. Such products are commercialised by CARRASCO IBÉRICOS through this website.
CONTRACTING PROCEDURE
The contracting procedure shall only be carried out in the Spanish language. If it can be carried out in another language, this shall be indicated before starting the contracting procedure.
In order to access the services offered by CARRASCO IBÉRICOS, the USER may:
- register through the website by creating a USER account,
- access the online store as a guest
In both cases, the USER shall provide the required personal data freely, voluntarily and in a truthful manner and without contravening the law.
For those users who choose to create a profile on the website, the USER shall select a USER name and a password, undertaking to make a diligent use of them, and not to make them available to third parties, as well as to notify CARRASCO IBÉRICOS of their loss or theft or of possible access by an unauthorised third party, so that the latter may proceed to block them immediately.
The USER shall not choose as a name words that are intended to confuse others by identifying them as a constituent part of CARRASCO IBÉRICOS, as well as expressions that are rude, offensive and, in general, contrary to the law, the morality or decency.
Once the USER account has been created, please be aware that, in accordance with the requirements of art. 27 of Law 34/2002 of Services of the Information Society and Electronic Commerce, the contracting procedure shall follow the steps below:
- Choice of products to be purchased
- Acceptance of the purchase by accepting the goods indicated in the “cart”
- Identification of the buyer, either with username and password, or as a guest
- Payment of the products purchased via a payment gateway through virtual POS or through the PayPal app
- Once payment is received, the buyer shall receive an e-mail confirming the purchase
- Finally, the buyer shall receive the products purchased at the address indicated and within the deadlines described.
In any case, as indicated in point 5, the CARRASCO IBÉRICOS contracting platform shall inform the USER, once the contracting procedure has been completed, by e-mail about all the characteristics, price, means of transport, date of contracting and estimated delivery.
ORDER DELIVERY
The delivery of the orders shall be made at the delivery address freely designated by the USER. CARRASCO IBÉRICOS shall not be liable when the delivery of the product or service does not take place as a result of the data provided by the USER being false, inaccurate or incomplete or when the delivery cannot be made for reasons beyond the control of the shipping company, assigned for this purpose, such as the absence of the recipient.
Notwithstanding the foregoing, CARRASCO IBÉRICOS shall take the steps of a diligent merchant to ensure that delivery is made within the agreed time, and if not, as soon as possible, to the satisfaction of the sender and the recipient, so that no liability can be attributed to CARRASCO IBÉRICOS.
PRICE AND VALIDITY PERIOD OF THE OFFER
The prices indicated for each product include Value Added Tax (VAT) or other taxes that may be applicable and in any case shall be expressed in Euro (€). These costs, unless expressly stated otherwise, do not include the costs of shipping, handling, packaging, insurance or any other additional services and annexes to the product or service purchased.
The prices applicable to each product shall be those published on the website and automatically applied by the contracting process during its last stage.
Any payment made to CARRASCO IBÉRICOS shall entail an invoice in the name of the registered USER. This invoice shall be automatically sent to the e-mail address provided by the USER, as well as sent together with the purchased product.
For information about the order, the USER can call the CARRASCO IBÉRICOS customer service telephone number 923580420 or send an e-mail to info@carrascoibericos.com. In any case, the order number assigned and indicated in the purchase confirmation e-mail shall be included in the subject line of the message or during the call.
RIGHT OF CANCELLATION
The USER shall have a period of 14 calendar days from the date of receipt of the product to return it.
As established in articles 102 and subsequent articles of Royal Legislative Decree 1/2007 of 16 November, which approves the revised text of the General Law for the Defence of Consumers and Users and other complementary laws, you are informed that:
- Products delivered in sliced and vacuum-packed format shall not be eligible for cancellation as they are not “suitable for return for health protection or hygiene reasons”
- Products “that have been unsealed after delivery” shall not be eligible for cancellation either.
- The products must be returned in their original packaging and in perfect condition.
In any case, CARRASCO IBÉRICOS shall provide the USER with a form to exercise the right of cancellation, which shall be duly completed as a prerequisite for exercising this right
APPLICABLE GUARANTEES
All products offered on the website have a legal guarantee period, according to the criteria and conditions described in Royal Legislative Decree 1/2007 of 16 November, which approves the revised text of the General Law for the Defence of Consumers and USERS and other complementary laws, taking into account the nature of the products offered through the website.
APPLICABLE LAW AND JURISDICTION
These terms and conditions shall be governed by and interpreted in accordance with Spanish law in those matters not expressly established. CARRASCO IBÉRICOS and the USER agree to submit any dispute that may arise from the provision of the products or services covered by these Terms and Conditions to the Courts and Tribunals of the USER’S domicile.
In the event that the USER is domiciled outside Spain, CARRASCO IBÉRICOS and the USER expressly waive their right to any other forum, submitting themselves to the Courts and Tribunals of the city of SALAMANCA (Spain).
